These sales terms (“Sales Terms”) govern the subscription to paid Maint Vision plans by business customers. They supplement the terms of use.

The Service is offered under several plans (for example a free plan and paid plans billed per user). The details of the plans and their limits are presented at subscription and in the billing area. Features may evolve.
Subscription is completed online. It requires acceptance of these Sales Terms and the Terms of use. The customer warrants that it is authorized to bind its Organization.
Prices are stated exclusive of tax and billed per active user, according to the chosen period (monthly or annual). Applicable VAT is added where relevant. We may change our prices; any change is notified in advance and applies at the next renewal.
Payment is made by card through our provider Stripe, by recurring charge on the due date. In the event of a failed payment, access to paid features may be suspended after a reminder. No card data is stored by the publisher.
The subscription is taken out for the chosen period (monthly or annual) and renews automatically for an identical term, unless cancelled before the renewal date from the billing area. Cancellation takes effect at the end of the current period.
A free plan and/or a trial period may be offered, with no commitment and no card required for the trial. We may change or discontinue a free plan upon prior notice.
As the Service is intended for professionals for the needs of their business, the right of withdrawal provided for consumers does not, in principle, apply. The business customer may nonetheless cancel under the conditions set out above. [TO COMPLETE: if you also target non-professionals, provide the 14-day consumer right of withdrawal.]
On termination, access to paid features ceases at the end of the paid period. You have a reasonable period to export your data; after that, it is deleted or anonymized in accordance with the privacy policy.
We provide the Service on a best-efforts basis and offer email support at contact@maintvision.com. No contractual service level (SLA) is guaranteed, unless separately agreed in writing.
To the extent permitted by law, our liability under the subscription is limited to direct and foreseeable damages and shall not exceed the amounts paid during the twelve (12) months preceding the triggering event. We do not warrant that the Service is fit for a specific need not made known to us and accepted in writing.
Neither party shall be liable for a failure resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code.
In the course of providing the Service, the publisher acts as a processor within the meaning of Article 28 GDPR for data processed on the customer’s behalf. The corresponding commitments and the list of sub-processors are set out in the privacy policy.
These Sales Terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution before any action. Failing that, jurisdiction is granted to the courts of the publisher’s registered office, subject to applicable mandatory rules.
